Terms & Conditions

Last updated: 16 October 2026

These terms apply to DotMax’s website at dotmax.io, the DotMax restaurant software and the QR menus and ordering pages it runs (together, the “Service”). By creating an account or using the Service you agree to them. If you accept them for a business, you confirm you are allowed to bind that business.

In these terms, “you” means the restaurant or business that holds the account, and the people it lets use it. Guests ordering from a restaurant’s QR menu should read section 10.

1. The Service

DotMax gives restaurants tools to run their business: menus, QR ordering, billing and payments recording, kitchen and waiter screens, stock, purchasing, staff, customers, loyalty, reports, a menu assistant and related features. The features you can use depend on your plan. We improve the Service continually, so features may change; we will not remove a core feature you pay for without telling you in advance.

2. Accounts and security

  • Give accurate details when you register, and keep them up to date.
  • Each person should have their own account. Keep passwords and PINs secret, and remove people who no longer work for you.
  • You are responsible for what happens under your accounts, including what your staff do.
  • Tell us straight away at info@dotmax.io if you think an account has been misused.
  • You must be at least 18 to register a restaurant.

3. Your responsibilities as a restaurant

  • Your menu, prices, taxes, service charges, offers, allergen and dietary information, and your food and service, are your responsibility. Keep them accurate.
  • Your bills, receipts and invoices must meet the tax and business laws that apply to you. Check the figures and settings before you rely on them.
  • You are responsible for your guests’ and customers’ personal data that you put into the Service: collect it lawfully, tell them how you use it, and get their permission where the law requires it, including before you send them marketing text messages.
  • If you connect your own SMS gateway, your agreement with that gateway, its charges and the messages you send are yours.
  • Check the results of automatic features before you use them, such as dishes and prices read from a menu photo.
  • Keep your own copies of records the law requires you to keep, and have a simple fallback (such as paper order pads) for when the internet or a device is down.

4. Acceptable use

You must not:

  • break the law, or use the Service for fraud, misleading prices or unlawful marketing;
  • try to get into accounts, data or parts of the Service you are not allowed to use, or test its security without our written permission;
  • disrupt or overload the Service, or use automated tools to scrape or copy it;
  • upload malware, or content that is illegal, offensive or infringes someone else’s rights;
  • copy, resell or reverse-engineer the Service, except where the law allows it.

5. Plans, fees and payment

  • Prices are shown on our website or in your quote, plus any taxes that apply. A free trial, if offered, ends on the date shown in your account.
  • Fees are billed in advance for each billing period and are due by the date on the invoice.
  • If an invoice is overdue, we will remind you first. If it remains unpaid, we may limit or suspend the account after giving you notice. Your data is kept safe while the account is suspended.
  • We may change our prices. We will tell you at least 30 days before a change affects you, and it applies from your next billing period.
  • Fees already paid are not refundable, except where the law requires a refund or we agree to one in writing.

6. Your data

You own the data you put into the Service. You give us permission to store and process it only to provide, secure, support and improve the Service for you, as described in our Privacy Policy. For your guests’ and customers’ personal data we act on your instructions.

You can export reports from the Service at any time. If you ask, we will give you a copy of your data in a common format when your account closes. After closure we delete or anonymise it within 90 days, unless the law requires us to keep it longer.

7. Other services

Some features rely on services run by other companies, such as SMS gateways, WhatsApp and maps links, and the reading of menu photos. Their own terms apply to those services, and we are not responsible for them being unavailable.

8. The menu assistant and automatic features

The menu assistant answers from the restaurant’s menu and from answers taught to it, and it may sometimes be wrong. It does not give medical, allergy, legal or financial advice. Guests with an allergy or dietary need should always confirm with the restaurant’s staff before ordering.

9. Availability and support

We work hard to keep the Service running and secure, but we cannot promise it will always be available or free of errors. We may need short maintenance breaks, and will try to schedule them at quiet times. Support is available by email and phone at the contact details below.

10. Guests using a QR menu

When you order from a restaurant’s QR menu, you are buying from that restaurant, not from DotMax. The restaurant is responsible for its menu, prices, food, allergen information, service, payments and refunds. Please raise any problem with the restaurant. Its use of your personal data is explained in our Privacy Policy and in any notice the restaurant gives you.

11. Our intellectual property

The Service, its software, design, our name and logos belong to DotMax. While your account is active you may use the Service for your business under these terms. Ideas and feedback you send us may be used to improve the Service, with no obligation to you.

12. Liability

  • The Service is provided “as is” and “as available”. To the extent the law allows, we give no promise that it suits a particular purpose beyond what these terms say.
  • We are not liable for indirect or consequential loss, such as lost profits, lost sales, lost data you could have exported, or business interruption.
  • Our total liability to you for any claims in any 12 months is limited to the fees you paid us in those 12 months.
  • Nothing in these terms limits liability that cannot be limited by law, such as for fraud.

You agree to cover our reasonable losses from claims made against us because of your content, your menu and prices, the way you use your guests’ and customers’ data, or your breach of these terms.

13. Suspension and closing an account

You can close your account at any time by contacting us. We may suspend or close an account that breaks these terms, puts the Service or other people at risk, or stays unpaid after notice. Where we reasonably can, we will warn you first and give you a chance to fix the problem. Sections 6, 11, 12 and 15 continue after an account closes.

14. Changes to these terms

We may update these terms. We change the date at the top, and tell restaurants about significant changes at least 14 days before they take effect. If you keep using the Service after that, the new terms apply.

15. Governing law

These terms are governed by the laws of Sri Lanka. We will first try to settle any disagreement by talking to you. If that fails, the courts of Colombo, Sri Lanka, will decide it.
